Terms of Service

1. Introduction

Welcome to RentalPilot. These Terms of Service ("Terms") govern your access to and use of the RentalPilot platform, website, and services (collectively, the "Service") operated by RentalPilot ("we," "us," or "our"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.

2. Service Description

RentalPilot is an AI-powered property management platform that automates guest communication, maintenance triage, cleaning coordination, review management, and other day-to-day rental operations. The Service uses artificial intelligence to handle routine property management tasks on behalf of property owners and managers.

The Service is designed to assist and augment property management operations, not to replace professional judgment in all circumstances. You remain responsible for the management of your properties and compliance with all applicable laws and regulations.

3. Account Registration

To use the Service, you must create an account by providing accurate and complete information. You are responsible for:

  • Maintaining the accuracy of your account information
  • Safeguarding your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access

You must be at least 18 years of age and have the legal authority to enter into these Terms. If you are using the Service on behalf of a company or organization, you represent that you have the authority to bind that entity to these Terms.

4. Subscription and Billing

RentalPilot operates on a flat-fee subscription model:

  • Pricing: $49 per property per month, billed monthly
  • Billing Cycle: Subscriptions are billed on a monthly recurring basis starting from the date you add a property
  • Payment: You must provide a valid payment method. Payments are processed automatically at the beginning of each billing cycle
  • Price Changes: We may change our pricing with 30 days' written notice. Continued use after the effective date constitutes acceptance of the new pricing
  • Refunds: Subscription fees are non-refundable except where required by law. If you cancel mid-cycle, you retain access through the end of the current billing period
  • Failed Payments: If a payment fails, we will attempt to process it again. After repeated failures, your account may be suspended until payment is resolved

5. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You shall not:

  • Use the Service for any illegal or unauthorized purpose
  • Provide false, misleading, or inaccurate property information
  • Attempt to reverse-engineer, decompile, or extract the source code of the Service
  • Use the Service to send unsolicited communications (spam)
  • Interfere with or disrupt the integrity or performance of the Service
  • Attempt to gain unauthorized access to the Service or its related systems
  • Use the Service in any way that violates applicable local, state, national, or international law or regulation, including laws regarding short-term rental operations
  • Resell, sublicense, or redistribute the Service without our prior written consent

6. Data Handling and Privacy

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

By using the Service, you acknowledge that:

  • Property data you provide will be used to train the AI to respond to guest inquiries about your specific properties
  • Guest conversations handled by the AI are stored and may be reviewed to improve Service quality
  • You are responsible for ensuring you have the right to share any data you upload to the Service
  • You will inform your guests that they may be communicating with an AI assistant

7. Intellectual Property

The Service, including its original content, features, and functionality, is owned by RentalPilot and is protected by international copyright, trademark, and other intellectual property laws.

You retain ownership of all content you provide to the Service (property information, photos, communications, etc.). By uploading content, you grant us a non-exclusive, worldwide license to use, process, and store that content solely for the purpose of providing and improving the Service.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

  • THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED
  • WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE
  • WE ARE NOT LIABLE FOR ANY AI-GENERATED RESPONSES THAT MAY BE INACCURATE OR INAPPROPRIATE
  • IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM
  • WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF REVENUE, LOSS OF BOOKINGS, OR PROPERTY DAMAGE

You acknowledge that AI-generated communications may occasionally contain errors. You should regularly review AI interactions and maintain appropriate oversight of your property operations.

9. Indemnification

You agree to indemnify, defend, and hold harmless RentalPilot and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

10. Termination

You may terminate your account at any time through your account settings or by contacting us. We may terminate or suspend your account at any time, with or without cause, with or without notice, including if we reasonably believe you have violated these Terms.

Upon termination:

  • Your right to use the Service ceases immediately
  • We may delete your account data after a reasonable retention period (typically 30 days)
  • You may request an export of your data before account deletion
  • Any outstanding fees remain payable

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on the Service and updating the "Effective Date" above. Your continued use of the Service after such changes constitutes acceptance of the modified Terms.

For material changes that significantly affect your rights or obligations, we will provide at least 30 days' notice via email or prominent in-app notification.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in Delaware.
